Snapvine Privacy Policy

We know that protecting your personal information is important to our success. We appreciate your trust in us to use your private information carefully and responsibly and have created this policy to help you understand how we collect and use certain types of information.

Please take some time to read our policy. It's a good read and it's a legally binding document between you and us (Snapvine, Inc.)

  1. WHAT THIS POLICY COVERS

    This Policy describes how we at Snapvine will collect and use information when you use or access websites controlled and owned by us or software and services offered by us (the "Services"). This policy doesn't apply to the practices of companies that we don't own or control, or to people that we don't employ or manage. Although it seems obvious, for what it's worth, we don't control the conduct of our end users, including what they may do with the information you share with them.

    It's important that you review this policy on a regular basis, as we may change or update it from time to time. If we do make any changes to the policy, the changes will be effective as soon as we post the revised policy. If you continue to use our websites or Services after we post a revised policy, it means that you are ok with and accept the revised policy.

  2. Children's privacy

    THE SNAPVINE NETWORK OR SERVICES ARE NOT INTENDED FOR, AND MAY NOT BE USED BY, CHILDREN UNDER THE AGE OF 13.

    Our websites and Services aren't intended for children under the age of 13. We don't knowingly target our websites and Services to, or request, collect, use, or share information from, children under the age of 13. Unfortunately, as a result of fraud, mistake, or action by others, it's possible that we could receive information from or regarding children under the age of 13. If someone notifies us that we do have that type of information, we will promptly delete the information from our servers as soon as we can verify it.   3. OUR SERVICES

    1. Sharing Content and Materials with Others

      Certain Services may allow you to share content with other Snapvine users or the general public (we refer to this content as "User Content"). You may use the different tools and account settings in the Services to decide how much content (if any) you would like to share with others. Regardless of what tools you use, you shouldn't assume that this content is private. In fact, despite the best intentions of friends, and due to the open nature of the internet, you should assume that the content you share is (or will be) freely available to everyone. For that reason, we encourage you to be thoughtful about the type of information that you include in User Content, and encourage you to not include any sensitive or Private information.

    2. Communicating With Others

      Certain Services may allow you to communicate with the general public and Snapvine end users (we call these communications (you guessed it) "Communications"). In order to provide the Services to you and to improve the Services, we may store, process and maintain these Communications. For example, by storing your request we can send the message and also provide use-history information. Of course, sometimes you may change your mind about displaying certain Communications. We may provide tools as part of the Services to remove these Communications from public display. However, please remember that once you share the Communication with others, you may not be able to recall or control what that person will do with the information.

  4. What Information does Snapvine Gather?

    When you use our websites or Services, we may collect private information or general information. "Private information" means your full name combined with your email address, mailing address, telephone number or credit card number. However, we don't consider it Private information if you or someone else includes this information in your profile, User Content or Communications (either to Snapvine end users or to the general public). For example, if you set your profile to unrestricted access and include your telephone number as part of your profile, this information will not be considered Private information. "General information" means all the other information regarding you or your use of the Snapvine websites or Services. More details about Private information and General information are provided below:

    1. Registration Information

      In order to use many of our Services or access portions of our websites, you'll need to register or create an account with Snapvine. During registration you may have to furnish certain Private information such as your full name or email address. At other times we may provide sweepstakes, contests, or surveys. If we do, and you want to participate, you may need to provide us with other types of Private information.

    2. Profile Information

      As part of your use of the Services, you may choose to build out your profile by including different types of information. This could include the name/identity of your friends or acquaintances, your interests and hobbies, photographs, videos, and personal details such as your gender, date of birth, name, state, city or other types of information. Your account settings will allow you to manage certain aspects of your profile information. Again, we urge you to be cautious about including personal information as part of your profile, if you are concerned about the privacy or confidentiality of such information. We may store and use this information to provide you the Services, develop new services, improve the quality of our existing products, and for internal business purposes.

    3. Communications Between You and Snapvine

      In order to respond to requests and questions from you and to help us improve the Snapvine websites or Services, we may send you email messages and also store email messages between you and Snapvine.

    4. Usage Information

      We may collect General information regarding your use of our websites or Services. We collect this information through the use of cookies, pixels, beacons, or other similar technologies. For example, we automatically receive and record information on our server logs from your browser, including your IP address, cookie information, and the pages you request and other actions you take while accessing the Snapvine websites or Services. The information we collect includes the following:

      • Browser Information

        Every time you visit a page on the internet, your web browser sends specific information to the website you are visiting. Our servers automatically collect and store this information, including your IP address, specific type of browser software, operating system, the pages you visit at Snapvine, and information from Snapvine cookies (see below). This information may also be collected by third-party tracking companies that provide website analytics or advertising services to Snapvine.

      • Cookies, Beacons and Pixels

        We may set and access cookies, beacons or pixels on your computer. Like most sites that have interactive features, Snapvine uses these technologies to recognize you when you return to our websites or access Services, and to keep track of when you are signed in (so you do not have to re-sign in every time you visit a new page at Snapvine). We also use these technologies to target advertisements based on information provided by you (e.g. profile information, User Content, Communications), browser information (e.g. geographic location based on your IP address) usage or behavioral information, or past activities on Snapvine (e.g. whether or not you have seen or responded to a specific advertisement in the past).

  5. WHAT Information IS CollectED by Third Parties?

    We may allow third-party advertising companies and networks to place cookies, beacons, or other tracking mechanisms on our websites or the Services. In case you were wondering, a "third-party" just means that we don't own it or operate it — and neither do you. It's some other company all together. These third parties may collect general information and may use this general information either in the aggregate or individually for advertising or marketing purposes (i.e., in order to provide advertisements about goods and services that they believe may be of interest to you).

    As we said earlier, the web pages on our websites or Services may contain or link to features and content on websites which we don't own or operate. Products or services may be available through these web pages. When you access a product, service, or web page, you should look to see whether it is made available by Snapvine or by a third party. If it is from a third party, please read the applicable privacy policy carefully. Remember, our policy does not apply to those products, sites and services. Reading their policy will help you to understand the third party's practices regarding the collection, storage, and use of information.

    We may have advertising on our websites or Services. If you visit a website linked through an advertisement on our websites or Services (including banner, flash, audio, video, or other audiovisual advertising) you are generally visiting a third party website or service, and should review the applicable privacy policy.

  6. How CAN WE use and share Private information?

    We will not sell your Private information to third parties. We do use and share Private information for several reasons. First, we use it for the purpose for which it was provided and as set forth in this policy. Second, we may use your Private information in combination with other information about you received from third-parties in order to provide you with a better user experience, develop new services, improve the quality of our existing products, and for internal business purposes. Finally, we may disclose your Private information for the following reasons:

    1. Internal Business Purposes

      We may share Private information with third parties to complete transactions you have requested and to perform services on our behalf. When these third parties perform services for us, they are generally obligated to keep such information confidential and to only use the information for the purpose for which it was provided.

    2. Your Authorization

      We may disclose your private information if you authorize it. Sometimes, your authorization may be implicit in the use of the Services.

    3. To Protect Snapvine or its Users

      We may disclose private information when we believe it is appropriate to enforce or apply this policy, or our other policies or agreements; to initiate, render, bill and collect for amounts owed to us; to protect our rights or the rights of Snapvine end users, for safety reasons or to prevent damage to property; to protect Snapvine end users from fraudulent, abusive or unlawful use of the Snapvine websites or Services; or if we reasonably believe that an emergency situation requires or justifies disclosure of the foregoing information without delay.

    4. Subpoenas; Legal Proceedings

      We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may disclose your Private information in response to a lawfully issued subpoena or court order. We may share your private information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Snapvine, Inc. Terms of Use, or as otherwise required by law.

    5. Business Transfers/Mergers

      Private information may be disclosed or transferred as part of any Snapvine merger, acquisition, debt financing or sale of at least a majority of Snapvine assets, as well as in the event of an insolvency, bankruptcy or receivership. The transfer of such information in accordance with this paragraph shall not be construed as a "sale" of your private information.

    6. To Maintain and Provide the Services to You

      We may use private information to maintain and provide the Services to you. For example, we will use private information to maintain your account with Snapvine. This may include, for example, using your email address to communicate with you, or your postal address to send you information or notifications.

    7. Affiliates, Parent Companies and Subsidiaries

      We may transfer or share your private information with our affiliates, parent companies and subsidiaries; provided that such affiliates, parent companies and subsidiaries treat your private information consistent with this policy.

  7. HOW CAN WE USE GENERAL INFORMATION?

    We may freely use general information on an aggregate or individual basis for any reason and may allow third parties to do so. Please refer to our Terms of Use to learn more about the rights you grant to Snapvine with respect to general information.

  8. ADVERTISING

    We may include relevant advertising and related links based on the General information and other information related to User Content or Communications — you consent to our review of the User Content or Communications for this purpose. Additionally, to the extent you make any User Content or Communications available to other Users on an unrestricted basis, we may use such User Content or Communications for editorial purposes, or to promote the Snapvine websites or any of the Services. Please read our Terms of Use to learn more about the rights you grant to Snapvine with respect to general information.

    We may from time to time, send you marketing communications (which may take the form of emails, instant messages, account notifications, or other similar types of communications) regarding our Services, websites or third party products and services. You may either follow the opt-out instructions provided in the message we send to you, or log in to your Account and de-select the box indicating that you would like to receive those communications. We honor opt-out requests within 10 business days. Please be advised that if you choose not to receive marketing communications, you will continue to receive standard business communications regarding your transactions and account with us (e.g., confirmation emails, and information about your account).

  9. Security of your Information

    We use reasonable security measures to protect your Private information from unauthorized use and disclosure while the information is in our control. However, no security measures are perfect, and we cannot guarantee that your Private information will be secure from unauthorized access, use or disclosure. You transmit such information to Snapvine end users, the general public, or to Snapvine at your own risk. Among other things, hacking, software or hardware failure and other unauthorized access to our premises and systems may compromise the security of this information.

  10. NON-US RESIDENTS

    If you are not a United States resident, your use of the Snapvine websites or Services shall constitute consent to treatment of your private information in the manner described in this policy.

OTHER MATTERS

This policy is incorporated into and subject to the terms of the Terms of Use. If there is a contradiction between the content of this policy and any provision of the Terms of Use, the provisions of the Terms of Use shall control.
